Terms of Service

These terms govern use of FleetPanel ("the Service") — virtual private servers and related infrastructure provisioned on our own hardware and, for some plans, on upstream providers we resell. By creating an account or placing an order you agree to them.
1. The account
You're responsible for keeping your credentials and any SSH keys you upload confidential, and for all activity under your account. Tell us immediately if you believe your account has been compromised.
2. Acceptable use
You may not use the Service to:
- Send unsolicited bulk email, or otherwise abuse mail infrastructure.
- Scan, probe, or attack systems you don't own or have written permission to test.
- Host malware, phishing infrastructure, or command-and-control systems.
- Distribute content that is illegal in the jurisdiction where our infrastructure is located.
- Attempt to circumvent resource limits, billing, or the isolation between tenants.
We monitor connection metadata (counterparties, ports, volume — never packet contents) for patterns consistent with abuse — port scanning, excessive outbound mail, and similar. Flags are reviewed by a human before any action is taken; automated systems never suspend an instance on a heuristic alone. Confirmed abuse may result in suspension or termination, with notice where practical — immediate action may be taken where required to protect our network or third parties (e.g. an active attack in progress).
3. Billing
Service is prepaid and metered per second against your account balance. If your balance runs out, instances may continue running on a short overage allowance and grace period before being stopped — stopping never deletes data. An account stopped for non-payment and left unresolved for an extended period may eventually be terminated; we'll warn you by email before that happens, at every stage. Prices for existing instances don't change retroactively when we update a plan's list price — the rate you were quoted is frozen to your order.
4. Backups
Where a plan includes backups, they run on the same physical node as the instance they protect, on a daily schedule, retained for a limited number of restore points. This protects against accidental deletion, guest-side corruption, or a compromised instance — it does not protect against the failure of the underlying node itself. Backups are not a substitute for your own off-site copies of anything you can't afford to lose.
5. Availability
We aim for high availability but make no uptime guarantee under these terms unless a specific plan states otherwise in writing. Scheduled maintenance will be announced where practical.
6. Termination
You may cancel at any time from your dashboard; unused prepaid balance beyond the current metered period is not refunded unless required by law. We may suspend or terminate accounts that violate these terms, with notice where practical.
7. Liability
The Service is provided as-is. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from its use, including data loss — see the backups section above for what protection is and isn't included.
8. Changes
We may update these terms; material changes will be posted here with a new date. Continued use after a change constitutes acceptance.
